Recommendation 2
Identify stateless persons who have been displaced or migrated
across international borders in the context of climate change by
establishing and ensuring access to Statelessness Determination
Procedures. (also relevant to Recommendation 3 under Protect).
7.10 For additional information on SDPs, please refer to UNHCR’s
Global Action Plan 2.0, Action 6: In a migratory context, determine
statelessness and protect stateless persons and facilitate their
naturalisation, UNHCR’s Handbook on the Protection of Stateless
Persons, and UNHCR’s Good Practices Paper — Action 6:
Establishing Statelessness Determination Procedures to Protect
Stateless Persons.
Implementation:
This Recommendation is relevant in contexts where there are:
— Stateless persons and/or persons without a recognized
nationality status outside their own country.
Context:
7.8 Groups of people who have been displaced or migrated across
international borders in the context of climate change may include
stateless persons or persons without a recognized nationality
status. Alternatively, they may become stateless or persons without
a recognized nationality status once they have moved to a new
country due to gaps in or conflicts between the nationality laws of
their own country and the country that receives them.
7.9 The establishment of statelessness determination procedures
(‘SDPs’) in States receiving individuals from other States facilitates
identification of those who are stateless.51 Where SDPs already
exist, those who are stateless or without a recognized nationality
status should be given ready access to such procedures to ensure
that their nationality status is clarified.
Statelessness status determination is an essential first step to
ensure that the rights of all stateless persons in a migratory context,
including those moving for reasons related to the impacts of climate
change, are respected and upheld.52 Formal determination of
statelessness should also be linked to a facilitated pathway to
nationality of the receiving country. As of 2026, only 30 States
have established SDPs.53

To implement Recommendation 2, States can:
•Establish SDPs in line with the international legal definition of a
stateless person, and standards set out in the UNHCR Handbook
on the Protection of Stateless Persons.
•Ensure that persons who may be stateless and have been
displaced or migrated to another country in the context of climate
change can access SDPs.
•Provide guidance to decision makers to ensure that they are aware
of the country contexts and profiles of those migrants and refugees
who may be stateless in the context of climate change.
•Accede to the 1954 Convention and ensure that its provisions
are implemented in national laws and policies (also applies to
Recommendation 3)
