46 Global Recommendations on Nationality and Statelessness in the Context of Climate Change PART B 7. GLOBAL RECOMMENDATIONS | Recommendation 3 Global Recommendations on Nationality and Statelessness in the Context of Climate Change PART B 7. GLOBAL RECOMMENDATIONS | Recommendation 3 Protect the rights of stateless persons and persons without a recognized nationality status in situations where they are exposed and vulnerable to, or already affected by, climate-related hazards. This Recommendation is relevant in contexts where there are: — Stateless persons and/or persons without a recognized nationality status in their own country; and — Stateless persons and/or persons without a recognized nationality status outside their own country. Context: 7.12 The adverse impacts of climate change have the potential to exacerbate the negative consequences of statelessness or lack of recognized nationality status on enjoyment of human rights, including freedom of movement and liberty, access to healthcare, water and food, shelter, education, and work, as well as cultural rights.54 For example, climate change impacts may result in new or more severe diseases, and stateless people and persons without a recognized nationality status, who often do not have access to public health care, could become even more susceptible to acute and life-threatening illnesses. The fact that many stateless persons and persons without a recognized nationality status often work in the informal economy can make them more vulnerable to loss of livelihoods resulting from extreme weather events, and this vulnerability may be heightened by the common exclusion of stateless persons from access to social services.55 7.13 Additionally, stateless persons and persons without a recognized nationality status are often at risk of arrest or detention, forced eviction, expulsion and trafficking, due to their lack of legal status or restrictions associated with their legal status. In the context of climate change, increased resource scarcity and poverty, diminishing habitability of certain geographic areas, and the declaration of states of emergency all have the potential to increase the targeting and vulnerability of those who lack nationality or whose nationality status is unclear. II. Protect II. Protect Recommendation 3 For countries to ensure that stateless persons are included in their planning and responses to climate change they need to recognize the existence of stateless populations and persons without a recognized nationality status, and understand their specif ic needs. 47
