CONCLUSIONS AND RECOMMENDATIONS
ZAKLJUČCI I PREPORUKE
The issue of statelessness is not recognized as
a “real” problem in Croatia. This conclusion is
inevitable after examining the legal framework,
administrative practice, the case law and existing
policies which deal with statelessness. There are only
a few scholarly works which deal with this issue. This
also indicates how the problem of statelessness is
perceived in Croatian scholarly legal circles.
The Croatian legal order is, for the most part, aligned
with relevant international instruments to which
Croatia is a party. However, there are certain areas in
which there is room for improvement.
Namely, a person who acquires release from Croatian
nationality without previously acquiring a foreign
nationality (which is possible according to the CCA)
can become stateless if he or she does not acquire
a foreign nationality afterwards and if more than six
years passes after his or her release without notifying
Croatian authorities.
The second instance in which the CCA, in essence,
may cause statelessness relates to an especially
vulnerable group – children. According to the CCA,
children follow the legal position of their parents. If
the parents lose their Croatian nationality (either by
release or by renunciation), it is possible:

nakon ispitivanja pravnog okvira, upravne prakse,
sudske prakse i postojećih politika koje se odnose na
bezdržavljanstvo. Postoji samo nekoliko znanstvenih
radova koji se bave ovom problematikom, što
je dodatni pokazatelj toga kako se problem
bezdržavljanstva doživljava u hrvatskim akademskim
pravnim krugovima.
Hrvatski pravni poredak uglavnom je usklađen s
mjerodavnim međunarodnim instrumentima čija je
Hrvatska stranka. Međutim, u određenim područjima
ima prostora za poboljšanja.
Naime, osoba koja dobije otpust iz hrvatskog
državljanstva, a da prethodno nije stekla strano
državljanstvo (što je moguće prema ZHD-u), može
ostati bez državljanstva ako nakon toga ne stekne
strano državljanstvo i ako nakon otpusta u roku od
šest godina ne obavijesti hrvatske vlasti da nije stekla
drugo državljanstvo.
Drugi slučaj u kojem ZHD, u biti, može dovesti do
bezdržavljanstva odnosi se na posebno ranjivu
skupinu – djecu. Prema ZHD-u, djeca slijede pravni
status svojih roditelja. Ako roditelji izgube hrvatsko
državljanstvo (bilo otpustom bilo odricanjem), postoji
mogućnost:
a) that the parents will not acquire foreign
nationality (they only had proof that they would
acquire it) and therefore the child will become
stateless; or
a) da roditelji neće steći strano državljanstvo (imali
su samo dokaz da će ga steći) pa će stoga
dijete ostati bez državljanstva; ili
b) that the child will not acquire the nationality of
the parents according to the nationality laws of
the parents (less likely).

One could argue, when interpreting Article 7 CCA,
that it is possible for a child who was born or found
on the territory of Croatia to become stateless if the
parents are unable to transfer their nationality onto
the child as this provision prescribes that a child,
born or found (a foundling) on the territory of Croatia,
if both parents are unknown or are of unknown
