4.4 Procedures regarding Croatian nationality 4.4 Postupci o hrvatskom državljanstvu There exists a dual competence regarding the nationality procedures in Croatian law. Namely, some procedures are under the competence of the Ministry of the Interior, and some procedures are under the competence of the competent county offices (uredi državne uprave).139 U hrvatskom pravu u pogledu postupaka o državljanstvu postoji dvojna nadležnost. Naime, neki su postupci u nadležnosti Ministarstva unutarnjih poslova, a neki su u nadležnosti nadležnih županijskih ureda.139 There are differences in competences with regards to the type of procedure. When discussing nationality, there are several possible administrative procedures: Postoje razlike u nadležnosti s obzirom na vrstu postupka. Kada je riječ o državljanstvu, postoji nekoliko mogućih upravnih postupaka: g) stjecanje hrvatskog državljanstva ex lege; a) acquisition of Croatian nationality ex lege; h) stjecanje hrvatskog državljanstva prirođenjem; i b) acquisition of Croatian nationality through naturalization; and i) prestanak hrvatskog državljanstva: i. otpustom; c) termination of Croatian nationality: ii. odricanjem. i. through release; ii. through renunciation. County Offices have competences in administrative procedures regarding the acquisition of Croatian nationality ex lege,140 and the Ministry of the Interior has competence in administrative procedures regarding acquisition of Croatian nationality through naturalization and the termination of Croatian nationality. All Croatian nationals are entered into the Register of Citizens in Croatia, which is kept by the Registrar Offices at the county office in each county (i.e., City Registrar’s Offices of the City of Zagreb). The place of entry in the Register of Citizens depends on whether a child, who acquired Croatian nationality according to the ius sanguinis principle, was born in Croatia or abroad. The procedure is regulated by Article 27 of the CCA and by the Ordinance on the Contents and Way of Keeping the Register of Citizens, Form and the Price of the Form of the Certificate of Nationality.141 139 140 141 56 And city offices of the City of Zagreb, as there is no county office in the City of Zagreb because of the special position of the City of Zagreb. Consequently, such businesses in Zagreb are dealt with by the city offices of the City of Zagreb. Except in cases in which the circumstances regarding acquiring Croatian nationality are not clear when the competence falls under the Ministry of Interior. Then a request for determining Croatian nationality must be filed with the Ministry of Interior. Statelessness in Croatia Županijski uredi nadležni su u upravnim postupcima za stjecanje hrvatskog državljanstva ex lege,140 a Ministarstvo unutarnjih poslova nadležno je u upravnim postupcima za stjecanje hrvatskog državljanstva prirođenjem i za prestanak hrvatskog državljanstva. Svi hrvatski državljani upisuju se u evidenciju o državljanstvu u Hrvatskoj, koju vode matični uredi u županijskom uredu u svakoj županiji (odnosno gradski matični uredi Grada Zagreba). Mjesto upisa u evidenciju o državljanstvu ovisi o tome je li dijete, koje je hrvatsko državljanstvo steklo prema načelu ius sanguinis, rođeno u Hrvatskoj ili u inozemstvu. Taj je postupak uređen člankom 27. ZHD-a i Pravilnikom o sadržaju i načinu vođenja evidencije o državljanstvu, obrascu i cijeni obrasca domovnice.141 139 I gradskih ureda Grada Zagreba jer u Zagrebu ne postoje županijski uredi zbog posebnog položaja Grada Zagreba.
