succession of states as well as multiple nationality
and their consequences.27 However, Croatia has not
ratified this Convention, although it is a signatory to
it. The Act on the Ratification of this Convention was
scheduled in front of Parliament on two occasions,
but it never got to the stage of voting.28
The Convention does not allow reservations on
Chapter VI relating to the succession of states and
nationality. According to Article 18 para. 2 of the
Convention, which pertains to matters concerning
the granting or the retention of nationality in cases of
State succession, each State Party shall take account
of:

Konvencije, Hrvatska ju, međutim, još nije ratificirala.
U Saboru je u dva navrata bila zakazana rasprava o
prijedlogu Zakona o potvrđivanju te Konvencije, ali
rasprava nikad nije došla do faze glasovanja.28
Konvencija ne dopušta rezerve o poglavlju VI. koje se
odnosi na sukcesiju država i državljanstvo. U skladu s
člankom 18. stavkom 2. te Konvencije, koji se odnosi
na pitanja dodjeljivanja ili zadržavanja državljanstva
u slučajevima sukcesije države, svaka država stranka
posebno će uzeti u obzir:
a) izvornu i stvarnu vezu dotične osobe s
državom;
a) the genuine and effective link of the person
concerned with the State;
b) the habitual residence of the person concerned
at the time of State succession;
c) želju dotične osobe;
c) the will of the person concerned;
d) teritorijalno podrijetlo dotične osobe.
d) the territorial origin of the person concerned.
As mentioned above, international treaties, which
have been concluded and ratified in accordance with
the Constitution, have been published and which
have entered into force, shall be a component of
the domestic legal order of Croatia and shall have
primacy over domestic law. If the ECN were ratified,
it would be above the Croatian Citizenship Act (CCA)
in the hierarchy of legal norms. In that case, the
competent body (the Ministry of the Interior) would
be obliged to accept a request for the naturalization
of persons whose admittance into Croatian
nationality is not in the interest of Croatia but who
meet the criteria of Article 18 para. 2 of the ECN.29
Namely, the competent body has, according to the
CCA (see extensively infra), the discretionary power
to reject an application for naturalization if it finds
that such naturalization would not be in the interest
of Croatia, despite all criteria listed in the CCA being
met.

Kako je gore navedeno, međunarodni ugovori
koji su sklopljeni i potvrđeni u skladu s Ustavom i
objavljeni, a koji su na snazi, čine dio unutarnjega
pravnog poretka Hrvatske, a po pravnoj su snazi
iznad zakona. Kad bi Hrvatska ratificirala EKD, taj
bi instrument u hijerarhiji pravnih normi bio iznad
Zakona o hrvatskom državljanstvu (ZHD). U tom
bi slučaju nadležno tijelo (Ministarstvo unutarnjih
poslova) bilo dužno prihvatiti zahtjev za prirođenje
osoba čiji primitak u hrvatsko državljanstvo nije u
interesu Republike Hrvatske, ali koje udovoljavaju
pretpostavkama iz članka 18. stavka 2. ZHD-a.29
Naime, prema ZHD-u (vidjeti opširno u nastavku),
nadležno tijelo ima diskrecijsku ovlast odbiti zahtjev
za prirođenje ako utvrdi da to prirođenje ne bi bilo u
interesu Hrvatske, unatoč tome što su ispunjene sve
pretpostavke navedene u ZHD-u.
