BIRTHS AND DEATHS REGISTRATION ACT, 1992
DRAFT REGULATIONS ON THE REGISTRATION OF BIRTHS AND DEATHS, 2018
The Minister of Home Affairs intends, in terms of section 32 of the Births and Deaths Registration
Act, 1992 (Act No. 51 of 1992), to make the Regulations in the Schedule.
SCHEDULE
Definitions
1. In these regulations any word or expression to which a meaning has been assigned in the Act
shall have that meaning and, unless the context otherwise indicates—
“Children’s Act” means the Children’s Act, 2005 (Act No. 38 of 2005);
“confirmation of birth certificate” means a certificate issued to a non-South African citizen
confirming that the birth of his or her child occurred within the Republic and enables the holder
thereof to approach the relevant authorities of his or her country of citizenship or nationality in order
to register the birth of his or her child in his or her country of citizenship or nationality’s population
register;
“informant” means a person who gives notice of death under regulation 14;
“funeral undertaker” means a person who is designated as such in terms of section 22A of the
Act;
“identity document” means an identity document or card issued in terms of the Identification Act;
“Identification Act” means the Identification Act, 1997 (Act No. 68 of 1997);
“Immigration Act” means the Immigration Act, 2002 (Act No. 13 of 2002);
“Inquests Act” means the Inquests Act, 1959 (Act No. 58 of 1959);
“inspectorate” means the inspectorate established in terms of section 33(1) of the Immigration
Act;
