Deprivation of nationality General safeguard against Grounds for deprivation of nationality shall not be applied if the person will become stateless as a result. statelessness Provisions of this Act on the loss and deprivation of citizenship must not be applied if as a consequence of their application a person becomes stateless. A citizen’s deprivation of nationality does not extend to the children and the spouse of the sanctioned individual. Due process guarantees All persons subject to deprivation of nationality have a right to receive notification of any decision in writing, a right to a fair hearing, as well as a meaningful opportunity to contest or appeal that decision before a court or independent body. Any judgements on deprivation (and expulsion) shall be suspended pending the result of a final appeal. 37
