Bill will likely render similar outcomes, contrary to and undermining the Bill’s purpose to implement the CRC, and in violation of the State’s obligations under that treaty. Therefore, the ICJ respectfully recommends that the President request the parliament to review the section of the Bill pertaining to the right to nationality/citizenship, in order to: ensure compliance with the State’s obligations under the CRC by protecting the child’s right to nationality/citizenship; ensure consistency with objectives of the Bill; and clearly formulate the provision to enable effective implementation by officials and adjudication by courts. Our legal advisers would welcome an opportunity to discuss this, and to provide any technical assistance to ensure the Bill aligns with international law and standards.
