10 Global Recommendations on Nationality and Statelessness in the Context of Climate Change Global Recommendations on Nationality and Statelessness in the Context of Climate Change SUMMARY SUMMARY The following nine (9) Recommendations are provided as guidance as relevant in specific national and regional contexts: R1 Recommendation 1: R7 Identify and enumerate stateless persons and persons without a recognized nationality status in national counting exercises that are used to inform development and humanitarian policies, plans and programming, including for climate change adaptation, disaster risk reduction, and emergency preparedness, response and recovery. Ensure that all children are able to acquire a nationality in the context of climate change in order to prevent childhood statelessness. R2 Provide everyone with access to birth registration and proof of nationality documentation in contexts where people are vulnerable to or affected by climate-related hazards in order to prevent statelessness. Recommendation 2: Identify stateless persons who have been displaced or have migrated across international borders in the context of climate change by establishing and ensuring access to statelessness determination procedures. R3 Recommendation 3: Protect the rights of stateless persons and persons without a recognized nationality status in situations where they are exposed and vulnerable to, or already affected by, climate-related hazards. R4 Recommendation 4: Expedite the resolution of all known cases of statelessness, considering the compounding effects of being stateless in the context of adverse climate change impacts. R5 Recommendation 5: Assess relevant legal and policy frameworks to identify where potential risks of loss of nationality and statelessness may arise to prevent loss of nationality and statelessness in the context of climate change. R6 Recommendation 6: Prevent loss of nationality or voluntary renunciation of nationality that might lead to statelessness for those who are displaced or migrate across international borders in the context of climate change. R8 R9 Recommendation 7: Recommendation 8: Recommendation 9: Ensure that any bilateral or multilateral agreements that facilitate migration across an international border in the context of climate change protect against loss of nationality and statelessness. The Global Recommendations are intended to support practical action to prevent new cases of statelessness, reduce existing statelessness, and protect those whose rights are at risk in the context of climate change. They can be advanced through international, regional, national and local measures, including by integrating safeguards into nationality laws, and by informing efforts to strengthen civil registration and identity systems, human mobility frameworks, disaster risk reduction, emergency preparedness and response, and climate adaptation planning. While many measures can be built into existing frameworks and administrative practice, others will require focused follow-through, as well as additional technical and financial support, particularly for low-income countries. Implementing the Global Recommendations is therefore central to ensuring that nationality laws and civil registration systems, climate change law and policy, disaster risk reduction and response, and frameworks that govern human mobility are inclusive and capable of protecting those most at risk of being left behind. 11
