Feasibility study on a non-binding legal instrument regarding stateless children’s access to nationality

Description: This study focuses on the challenges related to the statelessness and access to nationality of children in Council of Europe member states. It was commissioned to inform the work of the Limited Working Group on Migration (CDCJ-MIG) in assessing the possibility of a non-binding legal instrument that could improve access to nationality for children and provide guidance on child-sensitive procedures relating to the determination of nationality or statelessness. The study examines the legal and practical challenges that had been identified by member states and CDCJ-MIG as the most relevant, providing a description of the relevant international standards and a summary of current rules and practice in member states. The study concludes with recommendations on appropriate follow-up and how new and pre-existing legal instruments can provide solutions.
