Description: This paper aims to identify the policy incoherence and gaps between the EU and Member states in addressing statelessness within the context of forced migration. It is pointed out that EU lacks competence to play a central role in this matter, which is illustrated by the analysis of relevant CJEU case laws and EU Treaty laws. The paper further looks at case studies of Germany, Italy, Hungary and Poland to illustrate the gaps in the legislative framework related to statelessness.
