GUIDELINES ON INTERNATIONAL PROTECTION No. 13:
Applicability of Article 1D of the 1951 Convention relating to the Status of
Refugees to Palestinian Refugees
UNHCR issues these Guidelines pursuant to its mandate, as contained in the Office’s
Statute, in conjunction with Article 35 of the 1951 Convention relating to the Status of
Refugees and Article II of its 1967 Protocol, as well as relevant regional instruments.
These Guidelines complement the UNHCR Handbook on Procedures and Criteria for
Determining Refugee Status under the 1951 Convention (Geneva: UNHCR, 1979;
reissued 2011) and other Guidelines on International Protection. They replace the
Revised Note on the Applicability of Article 1D of the 1951 Convention relating to the
Status of Refugees to Palestinian Refugees, October 2009, and all prior relevant
guidance. By contrast, the Note on UNHCR's Interpretation of Article 1D of the 1951
Convention relating to the Status of Refugees and Article 12(1)(a) of the EU
Qualification Directive in the context of Palestinian refugees seeking international
protection, May 2013, remains applicable.
These Guidelines, having benefited from broad public consultation, are intended to
provide legal interpretative guidance for governments, legal practitioners, decisionmakers and the judiciary, as well as UNHCR personnel carrying out mandate refugee
status determination under its mandate.
These Guidelines have been prepared in close cooperation with the United Nations
Relief and Works Agency for Palestine Refugees in the Near East (“UNRWA”).
In light of UNHCR’s equality and non-discrimination policies, wherever the original text
of an international agreement was drafted in gender-specific language and gender was
not in issue, the text needs to be read and understood today as if it applied equally to
men and women; for that reason, texts quoted in UNHCR publications reflect this
principle through the inclusion of appropriate wording in square brackets.
