Our key recommendations are as follows:
1. India must at least accede to the following
international legal instruments:
•
1954 Convention
•
1961 Convention; and
•
International Convention on the Protection of the Rights of
All Migrant Workers and Members of Their Families
(‘CRMW’).
2. India must enact a national legislation for
stateless persons that is consistent with
international law on statelessness
India must enact such an aforementioned legislation including
and not limited to provisions regarding the following issues:
•
Stateless persons in India shall have a path to citizenship.
•
The Indian state should provide an automatic path to
citizenship to all children who would otherwise be
rendered stateless.
•
The 1986 and the 2003 amendments to the Citizenship
Act must be done away with, keeping the pre-1986
amendment jus soli principle intact.
