Description: This report presents proposed legal provisions to help States reform nationality laws in line with international human rights standards. The draft articles are designed to support States in making nationality laws gender equal, whether based on jus soli (birthplace), jus sanguinis (descent), or both. Suggested reforms include using gender-neutral terms, such as replacing “father” with “parent”, to affirm that nationality rights are based one’s status as a citizen, not sex or gender. Developed with input from UNHCR and UN Women, the provisions serve as a guide for revising constitutions, laws and policies. Reform should be collaborative, involving civil society and affected communities. Read the Spanish version here.
