V.
Ensure nationality determination procedures for children are completed within a
reasonable timeframe, recognising that childhood is a limited period during which
delayed decisions irreversibly restrict access to rights, protection and development;
VI.
Ensure anti-trafficking and child protection responses are not dependent on migration
status by decoupling protection from enforcement, strengthening coordination between
migration authorities, child protection services and anti-trafficking mechanisms;
VII.
Collect and publish disaggregated data on children at risk of statelessness.
Protection:
VIII.
Ensure child-sensitive statelessness determination procedures (SDPs) and integrate
statelessness screening into trafficking and migration procedures, ensuring the best
interests of the child, access to guardianship, free legal assistance and low evidentiary
thresholds;
IX.
Ensure equal access to child protection and trafficking victim support services, including
reintegration and recovery programmes, regardless of their legal status;
X.
Provide access to stateless children to formal education, accreditation, and development
opportunities to enable them to access decent work in the future and lift themselves out
of the cycles of poverty and exploitation;
XI.
Implement clear firewalls between statelessness determination, child protection and
immigration enforcement to prevent detention, penalisation or removal of child victims.
Accountability:
XII.
Enhance the role of UN mechanisms in monitoring implementation and identifying gaps,
and ensure States fully implement UPR and Treaty Body recommendations, with specific
attention to stateless children in mixed migration and trafficking contexts;
XIII.
Remove nationality, residency and documentation barriers to justice, remedies and
compensation for child victims of trafficking, and implement child-sensitive procedural
safeguards that account for historical, ongoing and intergenerational rights violations;
XIV.
Recognise access to legal identity, residence and nationality as integral components of
reparation for stateless child victims of trafficking;
XV.
Strengthen cross-border cooperation in investigations, prosecutions and compensation
claims involving trafficked stateless children to address impunity and ensure access to
justice across jurisdictions.
