Hungary Hungary • An administrative SDP is conducted by the regional directorates of the National Directorate-General for Aliens Policing (NDAP). • The SDP was established under Chapter VIII of Act II of 2007 on the Admission and Right of Residence of Third-Country Nationals of 1 July 2007, and the Government Decree 114/2007 (V. 24.) on the Implementation of Act II of 2007 on the Admission and Right of Residence of Third-Country Nationals. • Good practices include: • applications accepted at any one of seven regional directorates of the NDAP; • applications accepted whether made orally or in writing and in any language; • applicants provided a temporary residence certificate if needed; • mandatory preliminary and detailed personal interviews; • the availability of legal assistance and interpretation and no requirement of certified translation in case of documents submitted in a foreign language; • in practice, a shared burden of proof; • UNHCR participation in proceedings, including access to files; • the availability of judicial review of negative first-instance decisions; • quality assurance in the form of in-house and joint UNHCR/NDAP audits of interview records; • decisions based on parameters specified by a Quality Assurance Manual for the SDP (October 2012). • Refugee status determination is conducted by the Asylum Directorate of the NDAP and is a separate procedure from statelessness determination, which is conducted by the Alien Policing Directorates of the same agency. 28 U N H C R > G P P AC T I O N 6 : E S TA B L I S H I N G S TAT E L E S S N E S S D E T E R M I N AT I O N P R O C E D U R E S
