Description: This report presents the first comprehensive study of statelessness in Australia and one of the most comprehensive studies of statelessness globally. The report is based on analysis of tribunal and court decisions and interviews with stakeholders including lawyers, health workers, policy experts, community workers, UNHCR Australia officers, government officers, and people with lived experience. It finds stateless people are often not counted or recognised, with experiences shaped by visa category, complex legal issues, systemic exclusion, profound impacts on their lives, and inadequate protection within a fragmented and reactive legal framework. It recommends reform including a Statelessness Determination Procedure, improved data collection, simplified and timely citizenship pathways, an end to mandatory detention of stateless people, and an end to offshore transfer and removal practices.
