3.1 International instruments and their
position in the Croatian legal order
3.1 Međunarodni instrumenti i njihov
položaj u hrvatskom pravnom poretku
All international treaties which Croatia is a party to,
and which have been concluded, ratified, published
in the Official Gazette, and have entered into force,
have primacy over domestic laws.22 This means
that if there is a clash between domestic laws and
international treaties, domestic law does not apply
and domestic bodies and courts are obliged to
directly apply international treaties. However, this
only pertains to international treaties concluded after
the entry into force of the Croatian Constitution in
1990. The implementation of international treaties
concluded between the former Socialist Federal
Republic of Yugoslavia/Federal People’s Republic
of Yugoslavia (SFRY/FNRY) and international
organizations and/or foreign countries, before 1990,
is regulated in Title III of the 1991 Constitutional
Decision on the Sovereignty and Independence of
Croatia.23 Therefore, international treaties, which
the former SFRY was a party to, will apply, provided
that the issue of the succession of the former SFRY
is settled, and with the specified restriction that they

novinama i stupili su na snagu, imaju prednost nad
domaćim zakonima.22 To znači da se, ako postoji
sukob između domaćeg zakona i međunarodnih
ugovora, domaće pravo ne primjenjuje, a domaća
tijela i sudovi dužni su izravno primjenjivati
međunarodne ugovore. Međutim, to se odnosi samo
na međunarodne ugovore sklopljene nakon stupanja
na snagu Ustava Republike Hrvatske 1990. godine.
Izvršavanje međunarodnih ugovora sklopljenih
između bivše Socijalističke Federativne Republike
Jugoslavije / Federativne Narodne Republike
Jugoslavije (SFRJ/FNRJ) i međunarodnih organizacija
i/ili stranih država prije 1990. godine uređeno je u
Glavi III. Ustavne odluke o suverenosti i samostalnosti
Republike Hrvatske iz 1991. godine.23 Stoga će se
međunarodni ugovori čija je bivša SFRJ stranka
primjenjivati pod uvjetom da je riješeno pitanje
sukcesije bivše SFRJ, i uz posebno ograničenje da

“International agreements which have been concluded and
ratified in accordance with the Constitution, published and
which have entered into force shall be a component of the
domestic legal order of the Republic of Croatia and shall have

Official Gazette no. 31/1991. The cited item prescribes:
“International treaties concluded and acceded to by the SFRY
shall apply in the Republic of Croatia provided they do not
conflict with the Constitution and legal system of the Republic
of Croatia, on the basis of the provisions of the international law
on state succession relating to international treaties.”
