OSCE and UNHCR describe12 different categories
of persons subject to statelessness or to the risk of
statelessness: De iure stateless persons who are
described as persons who are not considered as
nationals by any State under the operation of its law,
as set out in Article 1 of the 1954 Convention. De
facto stateless persons are described as persons
outside the country of their nationality who are
unable or, for valid reasons, are unwilling to avail
themselves of the protection of that country. Persons
with undetermined nationality are considered as
such when a preliminary review has not determined
whether they possess a nationality or are stateless.
OESS i UNHCR opisuju12 različite kategorije osoba
bez državljanstva ili osoba izloženih riziku gubitka
državljanstva: de iure osobe bez državljanstva koje
se opisuju kao osobe koje nijedna država prema
svom zakonodavstvu ne smatra svojim državljanima,
kako je utvrđeno u članku 1. Konvencije iz 1954.;
de facto osobe bez državljanstva koje se opisuju
kao osobe koje se nalaze izvan zemlje svog
državljanstva i koje ne mogu ili, iz valjanih razloga,
ne žele koristiti zaštitu te zemlje. Osobe se smatraju
osobama neutvrđenog državljanstva ako prethodnim
ispitivanjem nije utvrđeno imaju li ili nemaju
državljanstvo.
There is no formal definition in international law
specifying the terms “at risk of statelessness” and
”de facto statelessness”. However, from various
sources it can be concluded that persons are at risk
of statelessness when they have difficulties proving
that they have relevant links to a State.13
U međunarodnom pravu ne postoji službena
definicija kojom se određuju pojmovi „izložen riziku
gubitka državljanstva“ i „de facto bezdržavljanstvo“.
Međutim, iz različitih se izvora može zaključiti da su
osobe izložene riziku gubitka državljanstva ako teško
mogu dokazati da imaju relevantne poveznice s
nekom državom.13
