Non-Kazak nationality gives rise to fear of future persecution The BIA also failed to address the Petitioners’ fear of future persecution based on their non-Kazak nationality. The Petitioners presented solid support for this claim in the forms of an affidavit from Maureen Lynch, a senior advocate for statelessness initiatives at Refugees International and an expert nationals in in the treatment Kazakhstan; and of various non-Kazak country reports, including an excerpt from a recent U.S. State Department Report, which confirms an increase in government persecution of non-Kazak nationals. R. at 99-134. The BIA neither addressed this evidence nor attended to the Petitioners’ fear of future persecution when analyzing the prima facie case for asylum.
